Invalid water usage – efficiency

You can use this sample letter when you are being asked to pay water charges in your rented property but you are aware that there are not water efficiency devices fitted in your home.

I have received your letter dated [date]. You state that as your tenant I must pay a part of the water account. I do not have to pay any part of the water usage charge because the unit at the above address has not been made water efficient.

I refer you to section 39(1)(b) of the Residential Tenancies Act 2010 which forms clause 11.6 of the standard form of the residential tenancy agreement and gives the efficiency measures required before a tenant is liable for water usage charges.
