Invalid water usage charge - meter

You can use this sample letter when you are being asked to pay water charges in your rented property but you are aware that there is not a seperate meter for your property.

Re: Water usage charge at [your address]

I have received your letter dated [date]. You state that under the user-pays billing system each tenant must pay a part of the water account. I do not have to pay any part of the water usage charge because the premises at the above address is not separately metered for water.

I refer you to section 39 of the Residential Tenancies Act 2010, which forms clause 10.6 of the standard form of the residential tenancy agreement and states:

“10. The landlord agrees to pay: …

10.6 all charges in connection with a water supply service to residential premises that are not separately metered”.

I trust that this letter clarifies the matter.
