Request for consent to transfer co-tenancy

You can use this sample letter when you need to take your name off the lease in a share house, and have a new person ready to move in. It assumes you have not yet had a conversation with the landlord or agent. Also see Factsheet 18: Transfer and Sub-letting for more info.

Re: Transfer of co-tenancy at [your address]

I am writing to ask for your written consent to a transfer of my co‑tenancy at the above property. [Name/s of remaining co-tenant/s] intend[/s] continuing in the agreement with you. I wish to transfer my tenancy to [name of new co-tenant].  

A transfer document is enclosed for you to sign. I also attach proof of the [name of new co-tenant]’s ability to pay rent, and their references.

Please note that under section 75(2) of the Residential Tenancies Act 2010 a landlord cannot unreasonably withhold consent for a partial transfer of the tenancy.
