Bond not lodged
You can use this sample letter when the landlord or agent has failed to lodge your bond. Note that there are different time periods for the bond to be lodged by real estate agents and landlords without agents.

Re: Non-lodgement of rental bond for premises at [your address]
I signed a residential tenancy agreement for the above premises on [date]. I paid you the rental bond of $[amount] in full. To date I have not received confirmation that the rental bond has been lodged with NSW Fair Trading.
I draw your attention to section 162 of the Residential Tenancies Act 2010. It states:
“(1) A landlord, or landlord’s agent … who receives an amount of rental bond must deposit that amount with the Director-General within the deposit period …
(3) The deposit periods for a rental bond … are as follows:
(a) for a bond paid to a landlord or person other than a landlord’s agent – 10 working days after the bond is paid …
(b) for a bond paid to a landlord’s agent – 10 working days after the end of the month in which the bond is paid
…
(5) A person who contravenes this section is guilty of an offence. Maximum penalty: 20 penalty units.”
I ask that the rental bond be lodged as soon as possible.
